1. Agreement to Terms
By accessing or using NewHirely.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
NewHirely is operated by NewHirely, Inc. ("Company", "we", "us", or "our"). These Terms govern your access to and use of our employee onboarding automation platform.
2. Description of Service
NewHirely provides a cloud-based employee onboarding automation platform that enables businesses to:
- Create and manage digital onboarding workflows for new employees
- Collect and store employee documents securely
- Track onboarding progress in real-time
- Integrate with third-party services (DocuSign, Gusto, Calendly, etc.)
- Automate reminders and notifications
- Manage team members and organizational settings
3. User Accounts
3.1 Account Creation
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your information to keep it accurate and current
- Maintain the security of your password and account
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
3.2 Account Types
Owner Accounts: Business administrators who manage the organization and invite sub-users.
Sub-User Accounts: Employees completing onboarding processes created by their organization.
3.3 Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.
4. Subscription & Billing
4.1 Pricing Plans
NewHirely offers multiple pricing tiers based on the number of active employees. Current pricing is available at newhirely.com/pricing.
4.2 Payment Terms
- Subscriptions are billed monthly or annually in advance
- All fees are in U.S. Dollars and non-refundable except as required by law
- You authorize us to charge your payment method on a recurring basis
- Failure to pay may result in service suspension or termination
4.3 Free Trial
We may offer a 14-day free trial for new customers. At the end of the trial, you will be charged unless you cancel before the trial period ends.
4.4 Refund Policy
We offer a 14-day money-back guarantee on your first month's subscription. Refund requests must be submitted within 14 days of initial payment.
4.5 Price Changes
We reserve the right to modify pricing with 30 days' notice to existing customers. Price changes will not affect your current billing cycle.
5. Acceptable Use
You agree NOT to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Transmit viruses, malware, or harmful code
- Harass, abuse, or harm another person
- Impersonate any person or entity
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Use the Service for any illegal or unauthorized purpose
6. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
You retain ownership of all data you submit to the Service. You grant us a license to use, store, and process your data solely to provide the Service to you.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by NewHirely, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.
8. Third-Party Integrations
Our Service integrates with third-party services (DocuSign, Gusto, Calendly, etc.). Your use of these integrations is subject to their respective terms of service. We are not responsible for the availability, accuracy, or functionality of third-party services.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEWHIRELY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability shall not exceed the amount you paid us in the twelve (12) months prior to the event giving rise to the liability.
10. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Indemnification
You agree to indemnify and hold harmless NewHirely, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of any applicable laws or regulations
12. Termination
You may terminate your account at any time through your account settings or by contacting us. Upon termination:
- Your access to the Service will cease immediately
- We will delete your data within 30 days unless legally required to retain it
- You remain responsible for all charges incurred prior to termination
13. Data Retention & Deletion
Upon account cancellation or termination, we will retain your data for 30 days to allow for potential reactivation. After 30 days, all data will be permanently deleted. You may request immediate data deletion by contacting support@newhirely.com.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
16. Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court to protect intellectual property rights.
